BondedAI LLC & Bonded Payments Pty Ltd – Terms of Service

These Terms of Service ("Terms") form a legally binding agreement between you and the Bonded Group, comprised of:
Bonded provides a software platform that enables Australian dental clinics to accept and reconcile card, PayTo and BECS Direct‑Debit payments from their patients.
By creating an account or using any part of the Services you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Services.
You must be at least 18 years of age, or have parental/guardian consent, and be legally capable of entering into a contract under the laws of Australia.
Bonded provides:
We may add, modify or discontinue features on 30 days' notice (except in urgent security situations).
You agree to:
We may suspend or terminate your account for breach of these obligations.
When you authorise a payment you:
Bonded secures data using encryption in transit and at rest, MFA and least‑privilege IAM. Despite these measures, online services have inherent risks and you accept these risks. Our data‑handling practices are set out in the Privacy Policy.
You must not:
Except for liability that cannot be limited under the ACL, Bonded's total aggregate liability in connection with the Services is limited to the greater of (A) AUD 100 or (B) the total fees paid by you to Bonded in the 12 months before the claim. Bonded will not be liable for indirect, special or consequential loss.
You indemnify Bonded for any loss or claim arising from your breach of these Terms or applicable law, including reasonable legal fees.
We may suspend or terminate your access immediately for breach of these Terms, to comply with law, or to protect the security of the platform. Sections 7–12 survive termination.
These Terms are governed by the laws of South Australia, Australia. You submit to the exclusive jurisdiction of the courts of Adelaide.
Before commencing court proceedings (other than for urgent interlocutory relief) you must provide written notice of the dispute and the parties will use good‑faith efforts to resolve it within 30 days.
We may update these Terms by posting a revised version with a new effective date. Material changes will be notified 30 days in advance. Continued use after that date constitutes acceptance.
